Citizenship application delays – Class-Action lawsuit filed in St. Louis against the FBI, USCIS and Homeland security

A Class-Action lawsuit was filed in federal court in St. Louis Missouri on Friday on behalf of 33 Muslim plaintiffs challenging the US citizentship application wait times based on US Code Title 8, Chapter 12, Subchapter III, Part II, § 1447 (b) which states in part that,

“If there is a failure to make a determination under section 1446 of this title before the end of the 120-day period after the date on which the examination is conducted under such section, the applicant may apply to the United States district court for the district in which the applicant resides for a hearing on the matter.”

The plaintiffs allege that their wait times have been more than 120 days and in some cases as long as four years. The suit seeks to have a judge enforce the 120-day wait time as stated in the code.In addition to the agencies, the suit also names Attorney General, Michael Mukasey, Homeland Security Secretary, Michael Chertoff, FBI Director, Robert Mueller and acting director of U.S. Citizenship and Immigration Services, Jonathan Scharfen.
